HearBoost — Hearing Aid, Hearing Test & Sound Amplification

Please read these Terms of Service ("Terms") carefully before using HearBoost. By downloading, installing, or using the app, you agree to be bound by these Terms.

Medical Disclaimer

HearBoost is not a medical device and is not an FDA-approved hearing aid. The app is a personal sound amplification product (PSAP) designed to amplify environmental sounds for non-hearing-impaired individuals or as a supplemental tool.

HearBoost is not a substitute for a professional audiological evaluation, diagnosis, or treatment. If you suspect you have hearing loss or any other hearing-related condition, you should consult a licensed audiologist or healthcare provider.

Hearing Health Warning

Listening at high volumes may cause permanent hearing damage. Please use HearBoost responsibly:

• Start with low amplification levels and increase gradually.
• Do not use HearBoost at maximum volume for extended periods.
• If you experience pain, discomfort, or ringing in your ears, stop using the app immediately and consult a healthcare provider.
• Follow the volume recommendations provided within the app.

Hearing Test Disclaimer

The hearing test feature in HearBoost provides an estimate of your hearing ability for the purpose of personalizing your amplification settings. It is not a clinical hearing evaluation and should not be used to diagnose hearing conditions. For an accurate hearing assessment, please visit a licensed audiologist.

User Responsibilities

• You are solely responsible for using HearBoost at safe volume levels.
• You should consult a healthcare provider for any hearing concerns before relying on this app.
• You must not use HearBoost as a replacement for professionally prescribed hearing aids.
• You are responsible for ensuring that using HearBoost complies with local laws regarding audio recording and amplification in your area.

Lifetime Purchase

• HearBoost is available as a one-time lifetime purchase.
• Payment is processed through your Apple ID account and is subject to Apple's payment terms.
• After purchase, you receive lifetime access to all current and future features of HearBoost.
• Refunds are handled exclusively by Apple in accordance with their refund policy. We do not process refunds directly.

Intellectual Property

HearBoost and all of its content, features, and functionality are owned by Murat Can Cicek and are protected by copyright and other intellectual property laws.

Limitation of Liability

To the fullest extent permitted by applicable law, Murat Can Cicek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use HearBoost
• Any hearing damage resulting from use of the app at high volumes
• Any reliance on hearing test results or amplification settings provided by the app
• Any errors, inaccuracies, or omissions in the app's content or functionality
• Any unauthorized access to or use of your data

Disclaimer of Warranties

HearBoost is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

We reserve the right to suspend or terminate your access to HearBoost at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to These Terms

We may update these Terms from time to time. Continued use of HearBoost after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
